Petitioner's challenge is to the order dated 21-08-2024 (Exhibit-73) passed by the Court of Civil Judge, Senior Division, Khamgaon in Hindu Marriage Petition No.157/2016, by which the trial Court has rejected the application filed by the wife. By her application at Exhibit-73, the wife has prayed for dismissal of the petition for divorce on the ground that the husband has failed to pay arrears of maintenance.

In response to the notice, the husband has appeared in this petition and by order dated 24-12-2025 he was directed to deposit arrears of Rs.4,90,000/-. A statement is made by learned Counsel for the respondent that an amount of Rs.4,90,000/- is deposited through demand draft before the Court of Civil Judge, Senior Division, Khamgaon in compliance with order dated 24-12-2025.

In view of the payment of arrears of maintenance, the grievance raised by the wife by way of application at Exhibit-73 on which the impugned order is passed, does not survive. So also the grievance raised in the instant petition does not survive and hence the instant petition is disposed of. 5.

Parties are granted liberty to apply before the Court of Civil Judge, Senior Division, Khamgaon for expeditious decision of the Hindu Marriage
