The issue involved in the present Writ Petition is about granting night duty allowance to the eligible industrial employees of Ordinance Factory on the basis of revised pay scale and allowances drawn by them, as per 5th and 6th Pay Commissions recommendation. The above referred benefits have been granted in this case by the Central Administrative Tribunal vide order dated 17.07.2023 passed in O.A. No.437 of 2022, to the respondent employees.

Similar order was earlier challenged before this Court by way of Writ Petition No. 3702 of 2017, which came to be decided on 12.02.2020 against the petitioner. Thus, the issue involved in the present Writ Petition is covered by the judgment dated 12.02.2020 passed in Writ Petition No.3702 of 2017 (Union of India Vs. Ordinance Employees Union and others.)
