Mr. S.S. Shingane, learned counsel for the petitioner submits that the revision application under Section 257 of the Maharashtra Land Revenue Code, 1966 challenging the order impugned in this petition is pending before the Hon'ble Minister -respondent No.1 and the petitioner desires to prosecute the appeal. He, therefore, prays for permission to withdraw the petition with liberty to prosecute the appeal on merit.

Permission to withdraw the petition is granted. 3.

All factual and legal aspects raised in the petition are kept open.

In view of the controversy involved, the respondent No.1 is directed to expedite the hearing of the appeal and the

The petitioner is permitted to point out to the respondent No.5-Tahsildar, Chikhali about the pendency of the revision before the Hon'ble Minister and make a request with regard to taking the mutation entries, which may be considered by respondent No.5 appropriately.
