Challenge is to order passed by the trial Court allowing the application filed by the plaintiff for appointment of the Court Commissioner. Learned Counsel for the petitioner submits that in view of the pleadings in the plaint, the appointment of Court Commissioner is sought for, only with an intention to collect the evidence.
