Shri Ghurde, learned AGP makes a statement that because there was no document file along with the proposal showing that electricity connection was there on the land owned by the petitioner and where the measure structure of the colleges situated, the proposal was not considered for opening of college for the academic year 2024-2025. However, he makes a statement that if such requirement is fulfilled and complied with, the proposal of the petitioner would be considered for the academic year 2026-2027.

Shri Marathe, learned counsel for the petitioner submits that recently he has obtained the electricity connection and he will submit the necessary documents to the respondent-State for MJ Jadhav

In that view of the statement made by the learned AGP, nothing survives in this petition. Accordingly, the petition is disposed of with permission to the petitioner to furnish the copy of the documents showing the availability of an electric connection on the land owned by the petitioner. Thereupon, the respondents may consider the proposal of the petitioner for academic year 2026-2027.

Needless to mention that if any further deficiency is noticed, the same shall be immediately communicated to the petitioner within a period of one week from the date of submission of documents as regards the electricity connection which the petitioner undertakes to submit within one week from today.

If no deficiency is informed or communicated to the petitioner within one week as referred above, it will be presumed that there is no other deficiency. In that event, the respondent shall take the necessary decision in the matter regarding the grant of permission.
