Petitioners have challenged the order passed by the appellate Court rejecting the application under Order 41 Rule 5 of the Code of Civil Procedure, seeking stay to the execution proceedings in the appeal challenging the decree of refund of money. In view of the controversy involved, issue notices to the respondents, returnable after four weeks.

In the meantime, the proceedings of Regular Darkhast No.04/2022 shall stand stayed subject to the petitioners' depositing 50% of the amount mentioned in the decree within a period of two weeks before the Executing Court.
