Mrs. Sirpurkar, learned counsel for the petitioners pointed out the letter issued by the District Deputy Registrar, Co-operative Societies, Akola addressed to respondent No.1 - Recovery Officer, the Yavatmal Urban Cooperative Bank Ltd., Yavatmal dated 22/08/2025, which came to be issued in the light of the provisions of Rule 107 (11)(f) of the Maharashtra Cooperative Societies Rules, 1961. The said provision stipulates the period of validity of upset price. As per the said provisions, the validity period of upset price is six months. The District Deputy Registrar informed the respondent No.1 that the upset price fixed on 05/09/2024 is lapsed on 04/03/2025. He further declares that the notice of auction issued by the bank on 25/08/2025 is illegal.

In the circumstances, writ petition is disposed of as infructuous.
