Looking to the prayers made in the present petition, we are of the opinion that since the petitioner is claiming the gratuity, such decision shall be taken by the respondent no.2-Chief Executive Officer, Zilla Parishad, Chandrapur. Therefore, in the light of the fact that the petitioner has served as a Gram Sevak and thereafter on promotion as Extension Officer, initially in Panchayat Samiti, Chimur and on transfer at Panchayat Samiti Jiwati as Extension Officer, the claim of the petitioner for payment of gratuity needs to be considered in the light of relevant provisions of the Law.

Accordingly, writ petition is disposed of with a direction to the respondent no.2-Chief Executive Officer, Zilla Parishad, Chandrapur, to take a decision as regards entitlement of the petitioner to receive the gratuity, within a period of eight weeks from the date of receipt of this order.

Decision taken thereupon, shall be communicated to the petitioner from the date of such decision.

The Registrar (Judicial) is directed to communicate this order along with the copy of the petition to the respondent no.2-Chief Executive Officer, Zilla Parishad, Chandrapur, within two weeks from today.
