Learned Counsel for the petitioner seeks leave to delete respondent nos.6 to 8.

It is stated that the contesting respondents are served and the petitioner seeks time to file on record the affidavit of service. The affidavit of service be filed within two weeks. 4.

Learned Counsel for the petitioner submits that after the impugned order was passed, the trial Court has proceeded further and the suit is now fixed for final arguments and therefore he prays for interim relief. It is submitted that by the impugned order, the petitioner's application for joining as party defendant in the suit came to be rejected, despite there being no objection from the contesting respondents. The petitioner is owner of the suit property and is necessary party to the suit.

In view of this, proceedings of Regular Civil Suit No.903/2001 shall remain stayed till next date.
