The present petition takes exception to the order dated 12.08.2025 passed by the respondent No.2Divisional Joint Registrar of Cooperative Societies, Nagpur, rejecting application for grant of stay filed by the petitioners in appeal No.46 of 2025. The said appeal was filed in order to assail order dated 25.07.2025 passed by the Assistant Registrar Cooperative Societies, Nagpur, under Section 78A of the Maharashtra Cooperative Societies Act, 1961, thereby superseding the committee of Mahindra Bloomdale, Cooperative Housing Maintenance Society Limited, Khapri, Tah. and Dist. Nagpur, (Registration No.1753) and appointing a committee of administrators over the said society.

Vide order dated 03.09.2025, during the course of hearing, the learned Assistant Government Pleader representing the respondent Nos.1 and 2 made a statement that the order impugned will not be implemented

50.wp.4672.2025.odt till filing of reply. Vide order dated 13.10.2025, the interim arrangement was ordered to be continued, subject, however to condition that the superseded committee shall not take any policy decision in the matter.

The learned advocates for the petitioners and respondent No.3 jointly state that the petition can be disposed of by directing the respondent No.1 to decide the appeal within the stipulated time frame, while continuing the interim arrangement till disposal of the appeal. 4.

In view of the aforesaid, writ petition is disposed of by directing the respondent No.1 to decide the appeal No.46 of 2025 preferred by the petitioners as early as possible and in any case, on or before 31.07.2026. 5.

The parties shall appear before the respondent No.1 on 02.05.2026. Parties to note that separate notice for appearance will not be issued.

Till the disposal of the appeal, the order dated 26.05.2025 passed by the respondent No.2-Assistant Registrar Cooperative Societies, Nagpur which is impugned in the aforesaid appeal, shall not be implemented, subject to condition that the committee will not take any policy decision or any decision having financial implications, other than routine day to day expenses.
