The petitioners seek challenge to the impugned communication dated 26th December, 2024, issued by the respondent No.3 - Education Officer (Secondary), Zilla Parishad, Buldhana, thereby rejecting the proposal for grant of Shalarth ID to the petitioner No.3 on the ground that he has not qualified TET examination.

Mr. Karode, learned counsel for the petitioners, points out the certificate at page No.15 (Annexure-A), which grants minority status to petitioner No.1 - Trust as a religious (Muslim) and Linguistic (Urdu) Minority Institution. He further points out that the issue regarding the mandatory applicability of the TET examination to teachers working in minority institutions is sub judice before the Hon'ble Apex Court. He also
907.WP.5026.2025.odt 2/2 relies on the judgment of this Court (Aurangabad Bench) in Writ Petition No.11121/2023 (Dattatry Devidas Sonwale & Anr. Vs. The State of Maharashtra & Ors.), dated 7th September 2023, wherein the respondent - Education Officer was directed to grant Shalarth ID to the teachers, subject to an undertaking that they would abide by the final outcome of the matter pending before the Hon'ble Apex Court.

In view of the above, issue notice to the respondents, returnable on 10th October, 2025. 5.
