Heard the learned counsel for the petitioners and the learned Assistant Government Pleader for the respondents.

The grievance of the petitioners is that by way of communication dated 25/02/2025, the Education Officer (Secondary), Zilla Parishad Gondia refused to release the pending as well as regular salary of the petitioner No.3 w.e.f. 01/01/2022 on the ground that the petitioner No.3 has not acquired TET Examination by 30/03/2019, which is the cut-off date to acquire the said qualification. However, in view of the judgment of the Hon'ble Apex Court in Anjuman Ishaat-E-Taleem Trust v. The State of Maharashtra and others (Civil Appeal No.1385 of 2025 and connected Appeals), the period for acquiring TET Qualification is KHUNTE

904-wp5234.25.odt 2/2 extended by two years from the date of passing of the order i.e. 01/09/2025.

In view of the above cited judgment of the Hon'ble Apex Court, the reason for refusing to release the pending as well as regular salary of the petitioner No.3 does not exist. As such, the impugned communication dated 25/02/2025 is hereby quashed and set aside. The Education Officer (Secondary), Zilla Parishad Gondia is hereby directed to grant approval for releasing the pending as well as regular salary of the petitioner No.3 after verification within one month. The petition stands disposed of accordingly. No costs.
