Heard the petitioner in person and Mr. Palshikar, learned Assistant Government Pleader for respondent nos. 1 to 3/State. 2.
The Maharashtra Administrative Tribunal (for short, 'the Tribunal'), Nagpur Bench, Nagpur, while partly allowing Original Application No. 997 of 2022, filed by the petitioner challenging his termination, though it was observed in para 2 that there is a prayer for back wages along with quashing and setting the order of termination, the prayer for back wages was not considered and only direction for reinstatement of the petitioner was issued, which gave cause to the petitioner to file this writ petition.

Having gone through the entire judgment dated 1st April, 2025, passed by the Tribunal and impugned in the present petition, it is evident that not a single finding has been recorded by the Tribunal to justify the denial of back wages to the petitioner, nor has any reason been assigned for refusing such relief.

Thus, we are of the opinion that the matter needs to be remanded to the Tribunal for deciding the issue as regards back wages.

Accordingly, we pass the following order:
(i) The writ petition is partly allowed.
(ii) The matter is remanded to the Maharashtra Administrative Tribunal for deciding the issue as regards the entitlement of the petitioner to the back wages.
(iii) The Tribunal is requested to decide the issue as regards back wages within a period of three months from the date of production of copy of this order.
