Learned Counsel for petitioner submits that on last date Mr. Thakare, learned Advocate who appeared for respondent no.1 has informed him that respondent no.2 in the matter has expired and on the basis of that statement the Counsel for petitioner had sought leave to delete the name of respondent no.2. He submits that thereafter it is revealed that respondent no.2 is alive and the statement made by the Counsel for respondent no.1 was incorrect. Learned Counsel for the petitioner also filed on record a Pursis dated 06-10-2025, specifically stating therein that respondent no.2 is alive and his name needs to be continued in the petition as respondent no.2. Although, by order dated 05-09-2025 petitioner was directed to carry out the amendment forthwith, in view of the fact that respondent no.2 is alive, no amendment is now required to be carried out. Petitioner is permitted to serve respondent no.2 afresh.

Issue fresh notice to respondent no.2, returnable on 10-11-2025.
