Learned counsel for the petitioner submits that the petitioner is entitled for refund in terms of judgment passed by the Gujarat High Court in the case of Mohit Minterals Vs. Union of India (SCA 726/2018) which is confirmed by the Supreme Court in Civil Appeal No. 1390/2022 (Union of India Vs. Mohit Minterals Pvt. Ltd.).

Learned Assistant Government Pleader shall take instructions.

The respondents shall take corrective measures in terms of the aforesaid judgments. Stand over to 30-1-2026.
