On 23/01/2026, the following order was passed: "Learned counsel for the petitioner submits that the petitioner is entitled for refund in terms of judgment passed by the Gujarat High Court in the case of Mohit Minterals Vs. Union of India (SCA 726/2018) which is confirmed by the Supreme Court in Civil Appeal No. 1390/2022 (Union of India Vs. Mohit Minterals Pvt. Ltd.).
Learned Assistant Government Pleader shall take instructions.
The respondents shall take corrective measures in terms of the aforesaid judgments.
Stand over to 30-1-2026."

On instructions, the learned A.G.P. submits that the respondent is willing to consider the case of the petitioner, if a detailed representation is made supported by documents.

The learned Counsel for the petitioner is satisfied with the stand taken by the respondent.

Accordingly, the petition is partly allowed. The order dated 15/05/2025 passed by the respondent is hereby quashed and set aside. The
11.wp.5514.25 2/2 petitioner shall submit it's representation supported by documents within two weeks from today. The respondent shall thereafter take a decision within 60 days from the date of receipt of the representation. Needless to say that the respondents shall afford an opportunity of hearing to the petitioner.

The petition is disposed of in terms of above with no order as to costs.
