Heard the learned counsel appearing for the parties. 2.

Both the parties have made a categorical statement that the pleadings are completed. Despite the same, there is no compliance by the Presiding Officer, Debts Recovery Tribunal, Nagpur, of the directions issued by this Court vide order dated 26.09.2025 to take decision on the application filed under Section 17 of the Securitization and Reconstruction of Financial Assets and Enforcement of Security Interest Act, 2002 (for short, 'the SARFAESI Act') within fifteen days from the date of the order. Though the period of more than four months has lapsed, there has been no compliance with the directions issued by this Court by the Presiding Officer. 3.

This is not the first matter in which we have noticed such an approach on the part of the Presiding Officer of the Debts Recovery Tribunal, Nagpur. In various matters, we have passed orders considering the urgency involved. Such an approach on the part of the Presiding Officer is highly prejudicial to the interests of the parties appearing before the Debts Recovery Tribunal, Nagpur.

In that view of the matter, issue notice to Shri Pankaj Kumar, Presiding Officer, Debts Recovery Tribunal, Nagpur, as to why contempt action should not be taken against him. The notice is made returnable on 04.03.2026.

In the above referred backdrop, we further grant liberty to the petitioner to raise a challenge to the order passed in IA before the Debts Recovery Appellate Tribunal.

Stay granted in this petition in favour of the petitioner shall continue for a period of three weeks from today to enable the petitioner to approach the Debts Recovery Appellate Tribunal. 7.

Needless to mention that after expiry of the period of three weeks from today, the stay granted by this Court shall stand automatically vacated.
