Heard Mr. Mishra, learned Advocate for the petitioner. 2.

Petitioner's challenge is to order dated 15-09-2025 passed by respondent no.1, thereby vacating the interim relief which was earlier granted in favour of the petitioner.

Learned Counsel for the petitioner submits that the impugned order mentions that the petitioner who was the appellant before respondent no.1 and his Counsel were absent on 04-09-2025 and 10-09-2025 and therefore, the arguments of the respondents were heard and the interim relief is vacated. Learned Counsel for the petitioner submits that the appellant as well as his counsel were present on 04-09-2025 and 10-09-2025 but, they were not allowed to mark their presence on the order sheet. He submits that there are no signatures of any of the parties on the order sheets of 10-09-2025 and 15-09-2025 in the proceedings which are pending before respondent no.1. 4.

Considering the submissions advanced, issue notice to the respondents, returnable after four weeks.

Learned AGP waives service of notice on behalf of respondent nos. 1 and 2.

Respondent no.1 is directed to file affidavit also explaining the reasons for absence of signatures on the ordersheets about the proceedings held on 10-09-2025 and 15-09-2025. (Prafulla S. Khubalkar , J.
