This is an application filed by the petitioner for grant of permission to withdraw the instant petition and also for grant of permission to withdraw the amount, which is deposited in accordance with the order dated 16.10.2025.

Learned Advocate for the petitioner as well as learned Advocate for the respondent submit that the parties to the litigation have settled their controversy and Hindu Marriage Petition No.46 of 2021 is decided in terms of compromise.

In view of this, the petitioner seeks permission to withdraw the instant petition.

The petitioner is granted permission to withdraw the instant petition.

As regards the prayer of withdrawal of Rs.47,000/-, which is deposited in this Court in accordance with the order dated 16.10.2025, passed by this Court, it is pointed out that the terms of compromise does not specifically mention anything about entitlement of the parties to withdraw the said amount.

Having regard to the overall circumstances, it is directed that the amount of Rs.47,000/- be paid to the petitioner as well as the respondent in equal proportion. Accordingly, the petitioner is permitted to withdraw 50% of the amount and the respondent is also permitted to withdraw 50% of the amount.

In view of the above, the civil application as well as the writ petition are disposed of.
