In view of the para 6 of the affidavit of respondent Nos.1 and 2, we are of the opinion that the present petition is premature and at this stage nothing survives in this petition. The para 6 of the affidavit dated 22.01.2026 sworn by one Ashish Suryawanshi, Chief Manager (Personal), Moil Limited, reads thus : "6.

It is submitted that the answering respondents have floated an Expression of Interest (EOI) and not a tender for outsourcing perennial work. The EOI is as an early-stage document to gauge vendor interest and capability, explore market interest, understand capabilities, and identify potential suppliers to refine project requirements for a subsequent Request for Proposal (RFP). It is vehemently denied that the EOI creates any contractual obligation or that it was an offer or process contract."

In light of the above referred specific stand of the respondent Nos.1 and 2, which they have put on affidavit before this Court, we dispose of the present writ petition as it does not survive, with liberty to the petitioner to file a fresh, if such occasion arises. The writ petition is, accordingly, disposed of. 3.
