JANUARY 30, 2026 1) On a motion made by Mr. Kshirsagar, learned counsel for the petitioner, the Writ Petition is disposed of as withdrawn. 2) Points agitated in the present petition can be agitated in appeal, if the occasion arises.

3) Mr. Kshirsagar, points out that the evidence of both the parties was recorded and original defendant also filed evidence closed pursis. He states that thereafter, the original defendant died and his legal representatives have reopened the entire proceeding which is not permissible in law. The evidence closing pursis was filed on 17/01/2014. The suit is of the year 2011. It is pending for around 15 years.

4) In view of above, the learned trial Court is directed to expedite the suit and decide the same as early as possible and in any case on or before 30/01/2027.
