By this application, the petitioners seek permission to withdraw the instant petition with liberty to raise the grounds in the appeal bearing R.C.A. No.139 of 2023 and R.C.A. No.140 of 2023, pending before District Judge at Akola.

Since this application is filed even before the service upon all other respondents is completed and even before the matter is admitted, there is no reason to reject the request. Hence, the application is allowed and the petitioners are permitted to withdraw the instant petition with liberty to raise the grounds in the petition before the appellate court. Needless to state that the respondents are entitled to advance their submissions opposing the grounds before the appellate authority as and when situation arises. 3.

In view of the above, the civil application is allowed and writ petition is disposed of as withdrawn.
