The present petition pertains to a claim seeking compensation of Rs.50 lakhs as per the Government Resolution dated 4th August, 2021, on the ground that when the petitioner's mother died, she was working under respondent No.2 - Nagpur Municipal Corporation and it was the COVID-19 pandemic period. Thus, it is necessary to see whether the said Government Resolution dated 4th August, 2021, is applicable to the case of the petitioner's mother.

Admittedly, the petitioner's mother was working as a ClassIV employee in the Tax Department of the Nagpur Municipal Corporation and as per the reply of the Municipal Corporation, during the COVID-19 pandemic period, she was working in the Chairman Office / Marriage Registration Office at Gandhi Zone Mahal No. 6.

The Government Resolution dated 4th August, 2021, is specific as regards its applicability. As per Clause (1) of the same, it is applicable to those employees only, who were discharging duties in any manner directly or indirectly in relation to COVID-19.

Admittedly, the mother of the petitioner was not discharging any duty relating to COVID-19 as to make the petitioner entitle to receive such compensation as provided vide Government Resolution dated 4th August, 2021. Accordingly, we are of the opinion that the respondent No.2 - Nagpur Municipal Corporation has rightly denied compensation to the petitioner. Hence, the present writ petition is dismissed.
