This matter was heard extensively at the stage of admission when learned counsel for the respondent Nos.1 and 2 who appeared on Caveat, opposed the petition by relying upon two judgments in the matter of (i) New India Assurance Company Limited Vs. Hilli Multipurpose Cold Storage Pvt. Ltd., reported in (2020) 5 Supreme Court Cases 757 and (ii) SCG Contracts (India) Pvt. Ltd., Vs. K.S. Chamankar Infrastructure Pvt. Ltd. And Others, reported in (2019) 12 Supreme Court Cases 210.

In view of the contentions canvassed by the respondents, learned counsel for the petitioner requested for adjournment and matter was adjourned to 10.11.2025 and thereafter, to 19.11.2025, 10.12.2025 and at the request of petitioner the matter was again adjourned to 19.12.2025 by way of last chance. On 22.12.2025 it was adjourned to 09.01.2026, when it was not listed.
