In view of the judgment of Coordinate Bench of this Court in Writ Petition No.3828/2023 (Javed Aalam Misbauddin Siddiqui Vs. The Divisional Commissioner, Nagpur Division, Nagpur and Others) dated 10.10.2023, the learned AGP has raised preliminary objection to the maintainability of the petition on account of alternate remedy.

In view of this, learned counsel for the petitioner, on instructions, seeks permission to withdraw the petition with liberty to avail the alternate remedy.

Permission is granted.

In view the above, the writ petition is disposed of as withdrawn with liberty as prayed for.
