2.
Rule. Rule is made returnable forthwith. Heard finally with the consent of the parties.
3.
The petition challenges the inaction of the respondent No.1, not to include the name of the petitioner No.3 in the 'Shalarth Pranali', and prays for further direction for the issuance of 'Shalarth ID' in favour of the petitioner No.3.
4.
As can be seen from the averments in the petition that the petitioner No.1 - Society is a minority Educational Society, which runs and manages the petitioner No.2 - School, which is a 100% grant-in-aid school. On 19.06.2023, the petitioner Nos.1 and 2 advertised the post of Shikshan Sevak, and on 29.06.2024, interviews of total 15 candidates were conducted. On 01.07.2024, the petitioner No.2 appointed the petitioner No.3 on the post of
916 wp 6718-2025.odt 3/4 Shikshan Sevak, as he was found most suitable and eligible candidate. Thereafter, on 24.02.2025, the respondent No.2 granted approval to the appointment of petitioner No.3 on the post of Shikshan Sevak with effect from 01.07.2023. Thereafter, on 25.02.2025, the petitioner No.2 - School submitted a proposal for inclusion of the name of petitioner No.3 in the 'Shalarth Pranali' and issuance of 'Shalarth ID'. The Education Officer - respondent No.2 on 20.03.2025 forwarded the proposal to the respondent No.1 - Deputy Director of Education for issuance of the said 'Shalarth ID' in the name of petitioner No.3. However, since no action has been taken over the said proposal, which is still pending with the respondent No.1, the petitioners are constrained to approach this Court.
5.
We have heard Shri Jachak, learned Counsel for the petitioner. He takes us through the documents, which are the appointment letter and the approval granted to the appointment of petitioner No.3. These facts are more or less undisputed and therefore, in our view, it would be in the interest of justice to direct the respondent No.1, i.e., the Deputy Director of Education, to
916 wp 6718-2025.odt 4/4 decide the proposal filed by the petitioners on 25.02.2025, within a particular time span. We therefore pass the following order.
ORDER
i) The writ petition is allowed.
ii) The respondent No.1 - the Deputy Director of Education is hereby directed to decide the proposal submitted by the petitioners on 25.02.2025, regarding grant of 'Shalarth ID' and for release of regular salary to the said petitioner in accordance with law within four weeks from the date of this order.
iii) The petitioners to appear before the Deputy Director of Education on 04.03.2026 and apprise the authority of the said order.
6.
Petition is disposed off as such. No order as to costs. (NANDESH S. DESHPANDE, J.) (SMT. M.S. JAWALKAR, J.) Jayashree..
