The petitioner's challenge is to the order dated 01.10.2025, passed by the trial court, allowing the application for amendment.

Learned Advocate for the petitioner submits that the trial court has passed the impugned order without giving due consideration to the proviso to Order VI Rule 17 of CPC and in absence of anything to show that the plaintiff exercised due diligence, the impugned order is passed.
