Issue notice to the respondents, returnable on 5th December, 2025.

Mr. S.S. Doifode, learned Additional Government Pleader, waives service of notice on behalf of respondent Nos.1, 3, 4, 5 and 6.

The counsel for the petitioner submits that the issue involved in the petition is covered by the judgment passed by the Co-ordinate Bench in the case of Saurabh Sahu Vs. The State of Maharashtra, through the Finance Secretary and Ors. [Writ Petition No.8537/2025, decided on 01.07.2025].

Ms H Kavi, learned counsel appears for respondent No.2 and submits that she has yet not received Vakalatnama and, therefore, not able to make any statement.

We find such a submission quite strange. If learned counsel for respondent No.2 has instructions from the department to appear before the Court, she should have gone through judgment in Saurabh Sahu .Vs. State of Maharashtra [Writ Petition No.8537/2025, decided on 01.07.2025], which is referred to in our order dated 14.11.2025 and should have made a statement whether the dispute is covered by the said judgment. Nonetheless, we grant one more opportunity.
