Mr. D.V. Chauhan, learned Government Pleader has pointed out the judgment in the case of L & T Finance Limited vs State of Maharashtra and others reported in (2023)1 High Court Cases (Bom) 173, wherein it is mentioned that remedy available to the petitioner is to approach the Divisional Commissioner.

Learned counsel for the petitioner fairly states that, in view of the judgment, he will prefer an appropriate application before the concerned Divisional Commissioner and seeks permission to withdraw the writ petition.

In that view of the matter, the petitioner is permitted to withdraw the Writ Petition. The concerned Divisional Commissioner is directed to decide the application within two weeks from the date of its filing.
