Anil S/O Ramchandra Dhakate v. State Of Maha., Thr. Honble Commissioner, Tribal Research And Training Institute, Pune And ORS.
2025:BHC-NAG:12033-DB 1 955-wp-6932-25.odt
IN THE HIGH COURT OF JUDICATURE AT BOMBAY,
NAGPUR BENCH, NAGPUR.
WRIT PETITION NO. 6932 OF 2025 Anil S/o. Ramchandra Dhakate Vs.
State of Maharashtra and others ------------------------------------------------------------------------------------------------ Office Notes, Office Memoranda of Court's or Judge's Order Coram, appearances, Court's Orders or directions and Registrar's order ---------------------------------------------------------------------------------------------------- Shri A. M. Jaltare, Advocate for petitioner. Ms. Sangeeta Jachak, Addl. GP for respondent nos. 1 to 3/State. CORAM :- SMT. M. S. JAWALKAR & M. W. CHANDWANI, JJ.
DATED :- 13.11.2025 Heard.
2.
The learned Additional Government Pleader waives service of notice for respondent nos.1 to 3. 3.
The petition seeks directions to the Scheduled Tribe Certificate Scrutiny Committee, Gondia (for short, "the Committee") to accept the caste certificate issued to the petitioner by the Competent Authority in physical form while submitting proposal for caste validation by the petitioner.
4.
The contention is that recently a Portal has been prepared by respondent no. 1- State of Maharashtra for applying for issuance of validity certificate before respondent no. 2- Committee. In the said Portal, uploading of caste certificate in Form-C is mandatory. However, the
2 955-wp-6932-25.odt petitioner is holding a caste certificate which has been issued in the year 1988 therefore, it will take considerable time to get the caste certificate in Form-C from the SubDivisional Officer, Bhandara by the petitioner. 5.
Further contention is that the petitioner is intended to contest the Municipal Council, Pauni elections and the last date of filing of the nomination form is 17.11.2025 hence, the petitioner has sought the above referred directions.
6.
Having heard the learned counsel for the respective parties and having gone through the record, we feel it appropriate to direct respondent no. 2- Committee to accept the application of the petitioner for issuing validity certificate in physical form and also to issue an acknowledgment to the petitioner for the same on an undertaking that within reasonable time, the petitioner would submit the caste certificate in Form-C after obtaining it from the SDO, Bhandara.
7.
Needless to mention that by communication dated 04.11.2025, the Election Commission of Maharashtra has issued the directions to accept nomination form for contesting the elections even on an acknowledgment of submission of proposal for validation of caste certificate by the candidate. Therefore, no separate directions is required in this regard to respondent no. 4 and therefore, no notice is required to be issued to respondent no. 4- Election Officer.
3 955-wp-6932-25.odt 8.
The learned AGP is directed to inform the directions issued by this Court to respondent no. 2Committee. 9.
In view of the above, nothing survives in this petition accordingly, it is disposed of.
10.
Authenticated copy of this order be supplied to the parties.
