The petitioners' challenge is to the order dated 07.10.2025, passed by the appellate court on an application under Order 41 Rule 5 of CPC, by which the appellate court has rejected the said application.

Having regard to the controversy involved, issue notice to the respondent, returnable after four weeks.

It is pointed out that Advocate Mr. Bhattad had filed a caveat and had appeared on last date and therefore, the petitioners were directed to supply the copy of petition to the caveator. Today, Advocate Mr. Thakre, who appears on behalf of Advocate Mr. Bhattad, seeks adjournment for personal difficulties of Advocate Mr. Bhattad.
