The contention is that the proposal for the approval to the appointment of Junior Clerk forwarded by the petitioner no.2 has been refused by the respondent no.2 - Education Officer. It is further contended that the minority institution cannot be forced to absorb the surplus employees in the wake of decision in the case of Young Boys Education and Industrial Circle Vs. State of Maharashtra and others 1 and Canossa Society, Canossa Convent Mahakali Caves Road and another Vs. Commissioner, Social Welfare, Directorate, Government of Maharashtra and others 2. 3.
