Rule. Rule made returnable forthwith. Heard finally with the consent of learned counsels appearing for the respective parties.

The petitioner has approached this Court being aggrieved by the Review Medical Examination Report dated 21.11.2025, thereby declaring him unfit due to persistent high blood pressure from the post of Constable (GD) in Central Armed Police Forces (CAPFs), SSF, Rifleman (GD) in Assam Rifles and Sepoy in Narcotics Control Bureau Examination-2025.

Brief facts, leading to the present writ petition, are as follow :

Respondent No.1 had published an advertisement for the various posts for recruitment in CRPFs, SSF, Rifleman (GD) in Assam Rifles and Sepoy in Narcotics Control Bureau Examination-2025. The petitioner, being eligible, applied for the post of Constable (GD) Exam-2025 in CAPFs, SSF, Rifleman (GD) in Assam Rifles and Sepoy in Narcotics Control Bureau (DV/DME). The petitioner had filled up his form in Staff Selection Commission in the O.B.C. category for the post of Constable (GD) Exam-2025. He successfully cleared the written examination and physical examination and was, accordingly, called for Detailed Medical Examination (DME). In Detailed Medical Examination, he was declared unfit on 15.11.2025. Hence, he applied for Review Medical Examination.

The Review Medical Examination was conducted on 21.11.2025. In the aforesaid Review Medical Examination, the petitioner was declared unfit due to persistent high blood pressure, even at rest. The Review Medical Examination Report dated 21.11.2025 is at record page No.24 (Annexure - F). Being aggrieved by such declaration as unfit, the petitioner has approached this Court, by way of the present writ petition.

Respondent Nos.1 to 3, in response to the notice issued by this Court, filed a reply on 09.03.2026. Shri. Bramhe, learned counsel for respondent Nos.1 to 3, submitted that the Review Medical Examination gave a specific finding that the petitioner was suffering from persistent high blood pressure and thus, he was declared as unfit in terms of Clause 09(XIV) of Uniform Guidelines for recruitment Medical Examination for GOs and NGOs in CAPFs and AR issued vide MHA UO No.A.VI.1/2014-Rectt(SSB) dated 20.05.2015. Respondent Nos.1 to 3 have annexed the aforesaid Revised Uniform Guidelines for recruitment medical examination dated 20.05.2015 as AnnexureR-3, which is at record page No.50. Clause XIV of the aforesaid guidelines pertains to the examination of heart and vascular system. Para 1 of Clause XIV reads thus :
"1.
Examination of Blood Pressure. (Normal Range Systolic 100-140 mm of Hg, Diastolic 60 to 90 mm of Hg) Candidate should not be rejected on the basis of single high reading. In case the blood pressure is recorded to be higher than 140 mm systolic and/or 90 mm Hg diastolic, at least 2 more recordings should be taken in lying position at an interval of 2-3 hours before declaring him unfit. BP should be recorded in both arms. The candidate should be asked to relax and should not be subjected to strenuous/stressful activity immediately prior to the recording.
(Elevated blood pressure defined as the average of three consecutive sitting blood pressure measurements separated by at least 10 minutes, diastolic greater than 90 mmHg or systolic pressure measurements greater than 140 mmHg, is disqualifying)"

On the backdrop of the aforesaid guidelines, upon examining the Review Medical Examination Report, we observe that such examination was not conducted in accordance with the prescribed guidelines. All three readings seem to have been recorded at the same time without there being any interval of 2 - 3 hours before declaring the petitioner unfit, as directed by the aforesaid guidelines.

Shri. Bramhe, learned counsel for respondent Nos.1 to 3, also conceded to the aforesaid position and could not point out the compliance of the aforesaid guidelines.

In view of the above, we are of the considered opinion that the Review Medical Examination of the present petitioner shall be conducted afresh in strict compliance with the Revised Uniform Guidelines for medical examination issued by the Government of India, Ministry of Home Affairs.

In view of the above, we allow the present petition and set aside the impugned Review Medical Examination Report dated 21.11.2025.

The respondents are directed to constitute a fresh Review Medical Board which shall examine the petitioner inter alia in accordance with the regulations/guidelines dated 20.05.2015. The Review Medical Board shall be constituted within three weeks from today and at least four days advance notice be issued to the petitioner. 11.
It is made clear that, if the petitioner is found fit by the freshly constituted Review Medical Board, further action shall be taken in accordance with rules. It goes without saying, if the petitioner is aggrieved by any order passed to his prejudice, he shall seek such remedy as available in law.

Rule is made absolute in the aforesaid terms. No order as to costs.
