4] Mr. Z.Z. Haq, learned Counsel, waives notice for the newly added respondents.

5] Heard.

6] The issue revolves around date of birth of the petitioner, who is working as Principal in a

College run by respondent no.3 - Management.

Respondent nos. 4 to 8 are working as Assistant Professors. According to the petitioner, his date of birth is 1/10/1964, whereas, respondent nos. 4 to 8 contend that the petitioner's date of birth is 1/10/1962.

7] Respondent nos. 4 to 8 lodged a complaint in this regard with respondent no.1 - Joint Director of Higher Education, Amravati Division, Amravati, who, in turn, constituted a Committee of two Members. The Committee filed its report dated 5/4/2024 saying that the date of birth of the petitioner is 1/10/1962. The said report was submitted to respondent no.3 for taking action, however, respondent no.3, after conducting enquiry, came to the conclusion that the date of birth of the petitioner is 1/10/1964 and not 1/10/1962.

8] Respondent nos. 4 to 8 again approached respondent no.1, and again, a Committee is constituted, now consisting of three Members. An order to that effect is passed by respondent no.1 on 13/12/2025, which is under challenge.

9] The Counsel for respondent nos. 4 to 8 has invited our attention to documents, which they obtained from School, where the petitioner has taken education. First such document is Transfer Certificate issued by School, where the petitioner was admitted in 1st Standard and

continued education for the period from 8/7/1968 to 30/4/1975. The date of birth mentioned in certificate is 1/10/1962. Second such document is School Leaving Certificate issued by Madan Maharaj Vidyalaya Va Kamaldeep Kanishtha Mahavidyalaya indicating that the petitioner took education for 10th Standard and passed examination in April - 1978. The date of birth is mentioned as 1/10/1962. Similar is the date of birth mentioned in SSC Board Certificate.

10] When enquired, the Counsel for the petitioner, on instructions of the petitioner, who is present in the Court, submits that the petitioner was admitted in 11th Standard in RDIK College, Badnera. When further enquired whether the aforesaid documents were submitted to the School, the Counsel for the petitioner seeks time to take instructions.

11] Kept back.

(JUDGE) (JUDGE) LATER ON 12] The petitioner has tendered across the bar Pursis signed by him and identified by the Counsel. Taken on record. The Pursis reads as under :

"The petition sincerely tenders his apology to the Hon'ble Court and to all the respondents including all the interveners and accept that his date of birth is 1.10.1962, as recorded in his School Record."

13] The petitioner submits that he has filed the aforesaid Pursis by heart. Accepted.

14] The Counsel for the petitioner and the petitioner himself seeks permission to withdraw the petition.

15] Permission is granted. The petition is disposed of as withdrawn.
