The petitioners have approached this Court seeking direction to respondent No.1-Bank to implement its resolution dated 12/09/2025 forthwith and to issue appointment orders for the post of Clerk in favour of the petitioners within the stipulated period. 3.

Shri A. M. Ghare, learned counsel in response to the notice of this Court has filed written submissions on behalf of respondent No.1. Perusal of the affidavit filed on behalf of respondent No.1 reveals that respondent No.1-Bank has admitted that they have conducted recruitment process for various posts. Out of those 360, 261 posts were of Clerk. The respondent No.1-Bank has conducted the recruitment process in view of its resolution dated 25/01/2025 and has issued appointment orders to 261 candidates for the post of Clerk. However, for various reasons stated in paragraph 3 of the affidavit, 12 candidates have either not joined or have resigned or though reported remained absent and thus now there are 12 vacancies in the cadre of

2 102-WP-8387-25.odt Clerk. In view of above, the present petitioners are now entitled for being appointed.

Respondent No.1-Bank in paragraph 4 of its affidavit has specifically submitted that the Bank is also in need of the employees and was required to consider the candidates from the waitlist however, only because of "Code of Conduct" for Municipal Council's elections in the district, even after completing the administrative formalities, it could not issue the appointment orders. Now the elections are over, results are declared and therefore Code of Conduct has come to an end. In view of the above, the learned counsel for the Bank submits that the Bank will complete all the formalities and will issue appointment orders to the petitioners.

In view of the aforesaid, grievance raised by the petitioners stand redressed. Accordingly, the writ petition is disposed of. No order as to costs.
