The petitioner has approached this Court seeking challenge to the purchase order issued by the respondent No.2 in favour of the respondent No.5 in respect of the construction of Bituminous Treatment Road from Ural Jogalkhed to Paras for a total value of Rs.7,05,38,340/- (Rupees Seven Crores Five Lakhs Thirty Eight Thousand Three Hundred and Forty Only) for constructing the road measuring 3 Kms.

The petitioner had made a complaint to the respondent Nos.2 to 4 alleging several illegalities being committed in the tender process and issuing tender at 200% higher rate, which was not permissible. The purchase order issued in favour of respondent No.5, @Rs.2,35,00,000/- (Two Crores Thirty Five Lakhs Only) per kilometer and the tender amounting to a total cost of Rs.7,05,38,340/- (Rupees Seven Crores Five Lakhs Thirty Eight Thousand Three Hundred and Forty Only), is exorbitant.

The aforesaid complaint was made by the petitioner to the respondent authorities on 08.12.2025. Taking cognizance of the aforesaid complaint submitted by the petitioner, the respondent No.4 has issued an e-mail on 23.12.2025, thereby directing the respondent No.5 to stop work of the aforesaid road until further instructions. The aforesaid mail refers to the complaint regarding the execution of the work which was submitted by the petitioner and was received by the Head-Office. The copy of aforesaid e-mail was also forwarded to the petitioner. However, for the reasons best known to the respondents, immediately within one day, the respondent No.4 has issued another mail on 24.12.2025 to the respondent No.5, thereby permitting him to continue with the work.

The said e-mail refers to the reply received on behalf of respondent No.5. However, the copy of reply was not supplied to the petitioner nor any hearing was granted to him though entire proceedings had been initiated on the basis of the complaint filed by the petitioner.

In view of the above, issue notice to the respondents, returnable on 07.01.2026.

Ms. D.I. Charlewar, learned AGP waives service of notice on behalf of respondent No.1.

Petitioner to serve the respondent Nos.2 to 5 by usual mode, so also by private mode of service. In the meanwhile, there shall be ad-interim relief in terms of prayer clause (e) till the returnable date.
