3. According to the last order passed by this Court on 03.02.2026, the Petitioner was required to place on record fresh calculations and adjust the amount of Rs. 50,00,000/- earlier deposited. The Respondent was requested by this Court to consider the adjustment of Rs. 50,00,000/- deposited on 03.02.2026 and the request of the Petitioner to pay the balance of outstanding after adjusting the amount

to settle the matter finally.

4. The Petitioner has today tendered the deposit of an amount of Rs. 13,00,000/- through Demand Draft dated 18.02.2026, which both the parties have agreed to be the full and final amount to settle the dispute in Execution Proceeding No. 4/2022/A, before the Court of Civil Judge Senior Division, Vasco Da Gama which is pending.

5. Mr. Ashok Balkrishna Deshprabhu, Director of the Respondent Sanghi Brothers (Indore) Pvt. Ltd. is present in the Court and upon his instructions, learned Senior Advocate Mr. S. D. Padiyar submits that this amount shall be treated as full and final settlement of the dispute in the said Execution Proceeding, which shall be disposed of as withdrawn within a week from today.

The Registry of this Court shall accept the said Demand Draft dated 18.02.2026 for an amount of Rs. 13,00,000/- and on realising the said amount, shall transfer the said amount to the account of the Respondent Sanghi Brothers (Indore) Pvt. Ltd; the bank details of the Respondent have been furnished and are referred to in the previous orders of this Court. The transfer shall be effected within a week from realising the amount.

7. The Respondent represented by Shri. Ashok Balkrishna Deshprabhu, who is present in the Court undertakes to withdraw the

Execution Proceeding No. 4/2022/A before the Executing Court at Vasco Da Gama, within a week from today. On such application of withdrawal being made by the Respondent before the Executing Court, necessary orders shall be passed to close the proceeding and record full satisfaction of the claim of the Decree Holder and further order shall be passed vacating/attachment of plots or residential house or any other immovable property, which is the subject matter of the attachment.

8. In view of the settlement of the disputes between both the parties, and on instructions, learned Advocate Ms. Laxmi Sawant, appearing for the Petitioner seeks to withdraw this petition. Writ Petition stands dismissed as withdrawn.

9. The Executing Court shall act on an authenticated copy of this order, which shall be placed by the parties before the Executing Court. VALMIKI MENEZES, J.
