DATED :- 6th April, 2026 ORAL ORDER:

1). Registry to waive office objections and register the Petition. 2). The Learned Advocate for Respondents No. 9 to 9 - Managing Committee of Devi Shree Bhagwati Devasthan at Parcem, submits that the concerned Panchayat has rejected the construction licence even though the Town Planning Department has granted technical approval. The said matter is under challenge before the Director of Panchayats in an appeal which has been filed on 27.03.2026. 3). Considering that there is no licence issued by the Panchayat as 6th April, 2026

39 WP 225 2026 of today, all works relating to the construction of the Bhakta Niwas at Survey No.2 of Village Parcem shall stand stayed until the Director of Panchayats decides the Appeal.

4). The Petitioner shall be impleaded by the Director of Panchayats as a Respondent to the pending Appeal and shall be heard prior to disposal of the Appeal. The Appeal shall be disposed of within three months from today.

5). In view of the above directions, nothing further would survive in the Petition. All the contentions which have been raised in this Petition under challenge to the construction may be taken up by the Petitioner in the pending Appeal. The Petition shall stand disposed of in view of the directions given above.

All contentions of the Respondents No.5 to 9 to be decided on their own merits by the Director of Panchayats. AMIT S. JAMSANDEKAR, J.
