2. The challenge raised in this Petition is to the three orders dated 10.01.2026, 07.02.2025 and 06.05.2025 passed under the Air (Prevention and Control of Pollution) Act, 1981 and Water (Prevention and Control of Pollution) Act, 1974.

3. Thereafter, the Pollution Control Board issued two final orders (air and water), both dated 06.02.2026, which are now challenged by the Petitioner in an Appeal before the Administrative Tribunal under Appeal Nos. Pollution Appeal No. 03/2026/Air and Pollution Appeal No. 04/2026/Water. The Petitioner has also challenged the aforesaid three orders and also the last two orders dated 06.02.2026, in Appeals pending before the Tribunal.

4. Since the three orders passed earlier are merged with the final orders dated 06.02.2026, the issue of limitation will not arise. More so, the earlier three orders, which are subject matter of challenge of the present Petition, are also challenged along with the merged orders dated 06.02.2026 before the Tribunal.

5. In this view of the matter, the present Petition is dismissed as rendered infructuous. The Tribunal shall consider the challenge to the orders dated 06.02.2026 along with the earlier three orders, without

entering into the question of limitation, since the first three orders have been merged with the orders dated 06.02.2026.

6. In view of the disposal of the main Petition, nothing survives in MCA No. 172 of 2026 and the same stands disposed of. AMIT S. JAMSANDEKAR, J.
