Vide order dated 10.11.2025, this Court had granted liberty to the Respondents to file reply with advance copy to be served on the Petitioner. Till date, no reply is filed. Today, Mr Cuncolienkar holding for Mr Gaurish Agni, learned Counsel for the Respondents, seeks some time to take appropriate instructions.

2. It is submitted by Mr Mulgaonkar, learned Counsel for the Petitioner, that on 17.01.2026, the learned Trial Court is likely to proceed with the evidence on behalf of the Plaintiffs and he apprehends that the present Writ Petition may be rendered infructuous if the Trial Court concludes the proceedings. 13th January, 2026

3. In that view of the matter, it would be necessary to request the learned Trial Court to defer the proceedings to any date beyond 18.02.2026.

4. Mr Cuncolienkar, learned Counsel holding for Mr Gaurish Agni has no objection to this arrangement. It is clarified that the deferment of the proceedings before the Trial Court is not to be construed as a stay of the proceedings.

5. List the Petition on 18.02.2026.
