1. The Petitioner has assailed the Order dated 18th July, 2025, passed by the learned Civil Judge Junior Division, 'F' Court, Merces Goa, whereby the application made by the Petitioner herein (original Defendant) seeking the stay of the suit before the Civil Judge Junior Division is dismissed with costs.

2. Mr Vengurlekar, learned counsel appearing for the Petitioner submits that when a similar proceeding was pending before the Labour Court involving the same issue, a subsequent civil suit before the Civil Judge Junior Division was not maintainable and could not be proceeded with during the pendency of the proceeding before the Labour Court. Hence, the Petitioner made an application under Section 10 of the Civil Procedure Code, seeking stay of the suit before the 20th January, 2026

WP 406 of 2025 CJJD. The said application was rejected leading to the filing of the present petition.

3. Issue notice to the Respondent, returnable on 23rd February, 2026.

4. A spare copy of the petition be provided to the Registry for facilitating the issuance of notice to the Respondent. In addition to the Court notice, learned counsel for the Petitioner is also permitted to serve privately by all means permissible in law and file an affidavit of service on or before the next date.
