1. It is submitted that the Petitioner has filed an application dated 13.08.2025 at CMA No.176/2025 of the record of the execution proceedings No.4/2024/A pending before the Court of Civil Judge Senior Division, Mapusa. In this application, the Petitioner sought an order of recall of a consent decree dated 23.08.2017, passed by the Civil Court in RCS No.154/2015/C. In addition, the application seeks a stay of the execution of proceedings pending on the same.

2. Learned Advocate for the Petitioner submits on instructions that the Petitioner would withdraw this petition with a prayer for seeking liberty, instead, an application at CMA No.176/2025 of the file of Executing Court.

3. Accordingly, the present petition stands dismissed as withdrawn with liberty as sought above.

4. Considering the nature of the application before the trial Court, the trial Court is requested to endevour to dispose of the application at CMA No.176/2025 preferably within three months from the date of this order.
