2. Learned Counsel for the Petitioner states that in the meantime, an Arbitrator has been appointed and the proceedings before the Arbitrator have been fixed on 22.11.2025. Considering this position, the learned Advocate submits that since the present Petition is against an order in the original application under Section 9 of the Arbitration and Conciliation Act, 1956, all the points agitated herein can now be raised before the Arbitrator in terms of Section 17 of the Act. Consequently, and on instructions, learned Advocate seeks to 19th November, 2025

WP 433 of 2025 withdraw this Petition to pursue remedies under Section 17 of the Act. The Petition stands dismissed as infructuous in view of the position recorded above.
