The parties have filed the Consent Terms, which are taken on record and marked 'X' for identification. Under the Consent Terms, the parties have settled their dispute. The Petitioner is represented herein by its General Manager (Operations) Michael Pereira, who is present in the Court and has identified

his signature on the Consent Terms. Respondent, Advocate L. Joseph Deva, is present in person in the Court and have identified his signature. Parties stated that they are aware of the Consent Terms and they have executed the same without any coercion or undue influence.

According to the agreement of the parties, the Petitioner would be entitled for a refund of Rs. 55,000/-, from the amount deposited in this Court (Rs. 5,05,132/-) on 20.03.2025. Accordingly, the Registry of this Court is directed to refund, out of the amount deposited under order dated 12.03.2025, the said amount of Rs. 55,000/- by transferring the amount directly to the Petitioner's account, details of which are stated in para 2(ii) of the Consent Terms.

Under the Consent Terms the Respondent is entitled to a balance amount of i.e. Rs. 2,82,584/- after deducting the earlier withdrawn amount of Rs. 1,67,548/- from the deposit of Rs. 4,50,132/-. This balance amount of Rs. 2,82,584/- shall be paid by the Registry directly to the account of the Respondent along

with all the interest that is accrued to the account on the entire sum of Rs. 4,50,132/-, from its date of initial deposit. The Registry to transfer this amount to the account of the Respondent details of which are given below:

Since the dispute between the parties has been fully settled by the Consent Terms, the Award of the Labour Commissioner dated 11.09.2024, which is impugned in this

petition shall be considered as satisfied fully. Consequently, if there is any Execution Proceedings pending, to recover the amount under the said Award, the same shall stand disposed of in view of the Consent Terms.

The petition is disposed of in view of the Consent Terms filed above.
