On hearing the learned Counsel for the parties, we are of the opinion that the Petitioner has an alternate efficacious remedy provided under the Central Civil Services( Classification, Control and Appeal), 1965 ("CCS Rules, 1965").

2. The order impugned in this petition is an order dated 29.7.2025, which was passed under Rule 11 of the CCS, Rules, 1965 and imposes a penalty of reduction of pay for a period of three years. Such an order 11th March, 2026

23 WP 505 2025 is appealable under sub-rule (ii) of Rule 23 of the CCS Rules, 1965 before the Appellate Authority.

3. The Petitioner claims that he was served with a copy of the impugned order sometime in November 2025 and has filed this petition on 4.12.2025, otherwise within a period of limitation provided by the said Rule 23.

4. Considering that the Petitioner has an alternate efficacious remedy, we dismiss this petition on the sole ground that there is alternate remedy available against the impugned order, however, considering that the Petitioner has approached the Court on 4.12.2025, as claimed by him, within the period of limitation provided under Rule 23, the Appellate Authority may consider the contentions of the Petitioner raised in this petition, in an appeal, if filed, in the light of the claim that the same is filed within limitation.

5. All contentions, including the contention raised by the Respondents that the appeal would be time-barred, are left open.

6. Writ Petition stands disposed of.
