O R D E R
(Passed on 22.03.2025) 1.
The parties to the appeal have settled the dispute on the terms contained in Form-H towards full and final settlement, which is annexed herewith. 2.
Settlement agreement has already signed by the respective parties, who were duly identified by the respective counsel. We have verified Venuai Ramdas Sontake, who appeared through Video Conferencing from District Legal Services Authority Centre, Akola, who also admit the execution of the settlement terms. Mr. B.S. Salunke, Project Director, NHAI, Amravati is physically present. Both admit the execution of the settlement agreement. 3.
It appears that the award has been passed in name of Gopal Ramdas Sontake also who was not party to the proceeding before the District Court and in this appeal. Since amount of award is required to be deposited in the executing Court, as per award, it is left to the executing Court to decide the entitlement to amount of award fell in the share of deceased Gopal Sontake. 4.
In view of above, appeal is disposed of in terms of settlement. 5.
