DATE : 20TH JANUARY, 2025 In both these petitions, a proposal has been given by Mr.Choube, learned counsel for the petitioners, that the petitioner will shut down the institution, however, the 44 students, which are presently studying in the final year of GNM Course because of the interim orders passed by this Court, be permitted to the transfer to one Shalom Nursing School, run by the Ashray Gram Vikas Sanstha, Wardha and be permitted to give the ensuing exam for the 3rd year from that school. The aforesaid Shalom Nursing School has also filed applications for being added as respondents in both these matters. Considering the above statements, we allow both these applications bearing Civil Application (W) ADGOKAR/KHUNTE
1-wp1476.21+1.odt 2/2 No.156/2025 in Writ Petition No.1476/2021 and Civil Application (W) No.157/2025 in Writ Petition No.5477/2021. Shalom Nursing School be added as respondent No.3 in both these petitions. The added respondent No.3 shall file an affidavit indicating its willingness to admit all these 44 students and the same being within its intake capacity.

Mr.Kene, learned counsel appearing for the respondent No.2 therefore to take appropriate instructions regarding the permission being granted by the respondent No.3 for such transfer and absorption of these students in the respondent No.3 and the willingness of the respondent No.2 to promote them to appear in the next examination from the respondent No.3, for the final year of the GNM Course. An affidavit in this regard shall be placed on record by the respondent No.2 by 30/01/2025. 3.
List the matter on 30/01/2025.
