No. 7 from the array of the respondents. It is stated in the application that the R.No. 7 has expired four to five years ago and the names of legal heirs of aforesaid respondent are not brought on record.

Thus, the appellant prays for deletion of name of aforesaid respondent from the array of the respondents in the present petition. The application is supported by affidavit.

Since the application is formal in nature and supported by affidavit, the same is allowed.

The petitioner is permitted to delete the name of aforesaid respondent from the array of respondents, at the risk of the petitioner.
