DATED : 28-04-2025 Writ Petition Nos. 5905/2015 and 5297/2017 were decided by common judgment. The operative part of order reads as under.

"1.

Writ Petition No.5905/2015 is allowed.

2.

Writ Petition No. 5297/2017 is dismissed.

The order dated 21/6/2008 passed by the Labour Court, Nagpur, to the extent, directing MSRTC to pay 50% back wages is quashed and set aside. Rest of the order dated 21/6/2008 passed by the Labour Court, Nagpur stands intact. Parties to act accordingly.

4.

The Writ Petitions are disposed of in above terms." The applicant - Maharashtra State Road Transport Corporation (MSRTC) has deposited 25% of back wages as directed by this Court vide order dated 22-3-2018. Since the petition filed by MSRTC is allowed and order directing payment of back wages is quashed and set aside, the applicant is entitled to withdraw deposited amount. The application is allowed as prayed for.
