The present Application is filed by the Respondent Nos. 5 & 6 for dismissal of the Writ Petition insofar as the prayer clauses (II), (III) and (IV) are concerned.
(2) This Court, in the judgment dated 07/05/2025 passed in Writ Petition No. 788/2023 (Jayshree Ashok Gotmare & ors. vs. State of Maharashtra & ors.) observed in para 43 as under:- "43. We, therefore, dismiss the petition by upholding the order of closure dated 19/05/2022 (Pg.67) and the consequent GR dated 27/10/2022 (Pg.72). 911caw1166.25 911caw1166.25 be paid to the staff of the respondent Nos.8 and 9-Institution, on account of the closure. The same shall be done within a period of three weeks from today. We also make it clear that since petitions seeking emoluments, to which petitioners claim to be entitled, bearing Writ Petition Nos.7365 and 1999 of 2018 are pending they shall be decided on their own merits."
(3) In view of the above judgment of this Court, learned Counsel for the Petitioners also conceded that prayer clauses (II), (III) and (IV) do not survive.
(4) As such, the Application is allowed. The Writ Petition stands dismissed insofar as prayer clauses (II), (III) and (IV) are concerned. However, insofar as the compensation part is concerned, the Respondent Nos. 2 and 3 are directed to take a decision about the payment of compensation to the Petitioners within a period of three weeks, as per the mandate of the order passed in Writ Petition No. 788/2023. Present Petition would survive to the extent of Prayer Clause (I).
(5) The Application stands disposed of.
